TACO BELL INDIA STANDARD TERMS & CONDITIONS

Welcome to Taco Bell India! These terms and conditions outline the rules and regulations for the use of Taco Bell India’s services and website.

By accessing this website and our services, we assume you accept these terms and conditions in full. Do not continue to use Taco Bell India’s website and services if you do not accept all of the terms and conditions stated on this page.

  1. Definitions

    "We," "Us," "Our," "Restaurant", “Company”, “Taco Bell India” refers to Burman Hospitality Pvt. Ltd. Who is the Master franchise for Taco Bell in India.

    "You," "Customer," "User" refers to anyone accessing our website or using our services.

    "Services" refers to all products and services offered by Taco Bell India, including food and beverage sales, both on-premises and through delivery or takeout options.

  2. Use of Services

    You must be at least 18 years of age to use our services or have parental consent.

    You agree to use our services only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of these services.

  3. Ordering and Payment

    Orders can be placed through our website, aggregators, mobile app, or in-store.

    Prices for our products and services are subject to change without notice.

    All payments must be made at the time of ordering, using the available payment methods provided.

    We reserve the right to refuse any order you place with us.

    All prices displayed on all communications inside or outside the store are exclusive of government taxes.

  4. Delivery and Takeout

    Estimated delivery times are provided as guidelines and are not guaranteed.

    We are not responsible for any delays caused by unforeseen circumstances or events outside our control.

    For takeout orders, you must collect your order within the designated pickup time frame.

    Delivery Orders are subject to the Customer’s address falling in the defined delivery area of the nearest Taco Bell Outlet.

    The delivery address is being mapped to the nearest Taco Bell India Outlet that delivers to the Customer’s area.

    In case the delivery locality is not listed in the Taco Bell India locator, delivery orders cannot be placed; however, Customers may choose to do Take-away from the nearest Taco Bell Outlet.

    Extra charges will be levied towards packaging charges to ensure the food reaches the Customer in a hygienic condition. The charges are subject to change without any prior notice.

    The menu is displayed as per the availability of the menu items in the Taco Bell India Outlet designated for the Customer’s location. In cases where certain menu items are not listed on the Menu Board, the Taco Bell India Outlet may not be carrying those items. In case of non-availability of ordered product after order placement at the designated Taco Bell India Outlet, the order will not be executed, and the Customer would be informed of the same.

    All product images are for illustration purposes only. Actual products may vary. Taco Bell India’s products are for immediate consumption for best flavor and taste.

  5. Cancellation and Refund Policy

    Customer Cancellation

    Customer shall not be entitled to cancel/modify the Order once placed.

    If Customer cancels his/her Order after placing it, Taco Bell India shall have a right to collect damages of 100% of the Order amount for breach of contract terms as a compensation for the damages suffered by Taco Bell with a right to either not to refund the Order value in case Customer’s Order is prepaid or recover from Customer’s subsequent Order in case his/her Order is post-paid (cash on delivery).

    Forced / Constrained cancellation

    Taco Bell reserves the right to collect damages for the Orders constrained to be cancelled by Taco Bell India for reasons not attributable to Taco Bell India including but not limited to:

    • In the event if the address provided by Customer is wrong.
    • Failure to contact Customer by phone at the time of delivering the Order.
    • Failure to deliver Customer the Order due to lack of information, direction, or authorization from Customer at the time of delivery.

    Non-Customer Cancellation

    If an item in an Order placed is unavailable, then Taco Bell India employee shall contact the Customer on the phone number provided at the time of placing the Order and inform the Customer of such unavailability. In such an event Customer will be entitled to cancel the entire Order and shall be entitled to a refund to an amount up to 100% of the Order value.

    In case of cancellations for the reasons attributable to Taco Bell India including non-availability of a Product, in case of a pre-paid order, Taco Bell shall refund the Order value within 7-15 working days to the Customer.

    The Orders placed by Customers using the Platform are non-cancellable and non-refundable except if refund is requested under the following conditions. Taco Bell’s decision on refunds shall be final and binding.

    • If Taco Bell fails to deliver the Order due to a cause attributable to either Taco Bell or its delivery agent.
    • If any of the items in the order is/are missing or wrong items are delivered, and for which concern in this regard has been raised by the Customer to Taco Bell concerned store within 10 mins of the delivery of the Order to the Customer.
    • If any of the items in the order is unavailable.
    • If the Order delivered to the Customer is damaged/of sub-standard quality subject to sufficient proof by the Customer in this regard. However, such refunds will be assessed on a case-to-case basis by Taco Bell.
    • If the packaging is tampered/unsealed/damaged, the Customer shall not accept the order. 100 % of the Order value shall be refunded, subject to the Customer not accepting the Order and raising a concern in this regard at the time of the delivery of the Order to the Taco Bell concerned Store.
    • If the payment is made and order is not placed, payments shall be processed in 7-15 working days.
  6. Allergies and Dietary Requirements

    Please inform us of any allergies or dietary requirements at the time of ordering.

    While we take care to avoid cross-contamination, we cannot guarantee that our food is free from all allergens due to the kitchen environment.

  7. Promotions and Offers

    Promotional offers and discounts are subject to specific terms and conditions.

    We reserve the right to withdraw or change promotions without prior notice.

    Promotions cannot be combined with other offers unless explicitly stated.

  8. Intellectual Property

    All content, including but not limited to text, graphics, logos, and images, is the property of Taco Bell India and is protected by applicable intellectual property laws.

    Unauthorized use of our content is prohibited.

  9. Liability

    To the maximum extent permitted by law, Taco Bell India shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services.

    Our liability for direct damages is limited to the amount paid by you for the services in question.

  10. Governing Law

    These terms and conditions are governed by and construed in accordance with the laws of India.

    Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.

  11. Amendments

    We reserve the right to amend these terms and conditions at any time without prior notice.

    Any changes will be effective immediately upon posting on our website.
